Abstract: The patient’s opposition to the use of their bodily organs or tissues ex mortuo has certain legal effects. In the article is presented the legal nature of a patient’s opposition to transplant post mortem. Not everyone have full legal capacity to make a decision about deposit and withdraw opposition therefore in the text are mentioned issues of entities empowered to undertake these activities.
