Abstract: The first part of the article discusses the issues in accordance with the law on organ donors and characterized the condition when the transplant is possible from a deceased donor (ex mortuo). The article presents under the law authorities, who have the power to express an effective opposition to collection of cells, tissues, and organs from human corpses for their transplantation. The second part of the article raises the issue of the child?s consent to organ transplantation. On the basis of medical law and the Civil Code, there are limitations on the ability of minors to consent for transplant. The article consider whether a minor is at all able to articulate consent in a conscious way, and whether the agreement will be characterized by voluntariness.Keywords: polish regulation, human trafficking, organ trade, the consent of the child
